Storm Water Pollution Prevention (SWPP) Plans
The EPA's National Pollutant Discharge Elimination System (NPDES) General Permit for Stormwater Discharges from Construction Activities regulates construction activities in the State of New Mexico. In general, preparation of a SWPP Plan and filing of a Notice of Intent (NOI) are required prior to commencement of project that disturbs more than 1 acre. Most other States have developed state-based programs approved by the EPA, such as the Texas Pollutant Discharge Elimination System. Requirements of the state-based programs are similar to the EPA NPDES program.
